The ISPS Code (International Ships and Ports Security), adopted by the IMO – International Maritime Organization, is a chapter of the SOLAS (Safety of Life at Sea) Convention, which aims to preserve the safety of maritime transport, through the implementation of international rules to be applied both on ships operating in the international trade, and the port facilities receiving them, consisting there regulations of two parts – “A” which is mandatory and “B” which is optional.
The European Union has adopted measures comprised on the Regulation CE/7525/2004 of the European Parliament and the Council of March 31, concerning the strengthening of the protection of ships and port facilities, complemented on the Directive CE/65/2005 of the Parliament and of the Council of 26 October, in what regards the strengthening of the safety in the ports, therefore, both parts mandatory.
In Portugal, Decree-Law N. 226/2006 defines the base structure of the national organization necessary to the operation and implementation of the code, transposing into internal legal and directive law.
The General Directorate on Natural Resources, Safety and Maritime Services (DGRM) is the Competent Authority for the Protection of Ships, Port Facilities and Ports Safety (ISPS).
